AFTER proper posting of public notice, a copy of which is attached hereto, on this the 11th day of September, 2006, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Proclamation of National Day of Prayer and Remembrance

    • MINUTE ORDER #361/06:  Judge Jon H. Burrows, read the Proclamation of National Days of Prayer and Remembrance, 2006 which was issued by President George W. Bush and observed a moment of silence in memory of the events of September 11, 2001.          



  2. Agenda #2 - Proclamation from Bell County Emergency Preparedness Coalition

    • MINUTE ORDER #362/06:  Dirk Aaron, with the Texas Cooperative Extension Belton office, and Steve Casey, Bell Count Emergency Management Coordinator and Fire Marshall, presented a proclamation declaring the week of September 10-16, 2006 as Disaster Preparedness Week in Bell County, which was read by Judge Jon H. Burrows.           



  3. Agenda #3 - Minutes

    • MINUTE ORDER #363/06:  Judge Jon H. Burrows, called to the Courts attention the fact that they had received the minutes of August 28, and September 1, 2006.  After due discussion, the minutes were approved as submitted. 



  4. Agenda #4a - Armed Services Y.M.C.A.

    • MINUTE ORDER #364/06:  Carlos De Los Santos and others from the Armed Services Y.M.C.A. in Harker Heights presented the Court and the County Engineer's Office with a statue of an Eagle to show their appreciation for the work provided on their new Harker Heights facility. 



  5. Agenda #4b - Purchase of several Caterpillar Motors

    • MINUTE ORDER #365/06:  Richard Macchi, County Engineer, presented for approval a request to advertise for the sale by bid of four caterpillar motor graders and the purchase of four new caterpillar 140-H motor graders off of the State Buy Board.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter. 



  6. Agenda #4c - 90" Packer/Roller

    • MINUTE ORDER #366/06:  Richard Macchi, County Engineer, presented for approval a request to advertise for bids for the purchase of a 90" Packer/Roller that will mount to a Motor Grader.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the request to advertise for bids. 


       
  7. Agenda #4d - Final Plat for Walker Ridge, Phase One

    • MINUTE ORDER #367/06:  Richard Macchi, County Engineer, presented the final plat for Walker Ridge, Phase One, a Two-Lot, Two acre development fronting onto West Hillyard Road, in precinct 3. After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter. 



  8. Agenda #4e - Final Plat for Walker Ridge, Phase Two

    • MINUTE ORDER #368/06:  Richard Macchi, County Engineer, presented the final plat for Walker Ridge, Phase Two, a Two-Lot, 2.084 acre development fronting onto West Hillyard Road, in Precinct 3.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter. 



  9. Agenda #4f - Plat for Harrell Subdivision

    • MINUTE ORDER #369/06:  Richard Macchi, County Engineer, presented the plat for Harrell Subdivision for final approval.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved this matter. 



  10. Agenda #4g - Letters of Credit No 1022 and 1023

    • MINUTE ORDER #370/06:  Richard Macchi, County Engineer, requested that Letters of Credit Numbers 1022 and 1023 be released, and that Letter of Credit No. 1027, First State Bank, be accepted for improvements in the Woods at Cedar Oaks, Section 2.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved to release Letters of Credit 1022 and 1023, and accept Letter of Credit No. 1027.



  11. Agenda #4h - Plat for Tull Addition

    • MINUTE ORDER #371/06:  Richard Macchi, County Engineer, presented the plat for Tull Addition for final approval.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter. 



  12. Agenda #4i - Set Public Hearing for Bunny Trail

    • MINUTE ORDER #372/06:  Richard Macchi, County Engineer, requested that a public hearing be set concerning the closure of a portion of Bunny Trail.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved setting a public hearing on October 10, 2006 at 9:00 a.m. with the regular Commissioner's Court Meeting.  



  13. Agenda #4j - Plat for Swaida Addition

    • MINUTE ORDER #373/06:  Richard Macchi, County Engineer, presented the Plat for Swaida Addition for final approval.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved this matter. 



  14. Agenda #4k - Contract with Able Tire Disposal

    • MINUTE ORDER #374/06:  Richard Macchi, County Engineer, presented for approval the contract with Able Tire Disposal, Burleson, Texas, for disposal of waste tires.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the continuation of this contract.  



  15. Agenda #4l - Striping of County Roads

    • MINUTE ORDER #375/06:  Richard Macchi, County Engineer, stated that thee was only one bid received coming from D.I.J. Construction, Bertram, Texas.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved D.I.J. Construction for the striping of County Roads.  



  16. Agenda #4m - Plat for the Village of Armstrong Addition

    • MINUTE ORDER #376/06:  Richard Macchi, County Engineer, presented the Plat for the Village of Armstrong Addition, for preliminary approval.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved this matter. 



  17. Agenda #5 - Personnel

    • MINUTE ORDER #377/06: Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER LANGE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.  



  18. Agenda #6 - FY 2006-2007 Budget

    • MINUTE ORDER #378/06:  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved the FY 2006-2007 Budget.  



  19. Agenda #7 - Bell County's and Bell County Road District's Tax Rates

    • MINUTE ORDER #379/06:  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the Order Adopting Bell County's and Bell County Road District's Tax Rate for FY 2006-2007.  The motion offered was:  I move that property taxes be increased by the adoption of a tax rate of $0.4110 for the 2007 tax year.  The tax rate includes Bell County's$0.3815 (which is comprised of $0.2855 for Maintenance and Operations and $0.0960 for Debt Service) and Bell County Road District's $0.0295, for a total of $0.4110.  THIS TAX RATE WILL RAISE MORE TAXES FOR MAINTENANCE AND OPERATIONS AND DEBT SERVICE THAN LAST YEAR'S TAX RATE.  THE TAX RATE WILL RAISE TAXES FOR MAINTENANCE AND OPERATIONS AND DEBT SERVICE ON A $100,000 HOME BY APPROXIMATELY $35.00. 



  20. Agenda #8 - Staffing for 2-1-1

    • MINUTE ORDER #380/06:  Judy Morales, Bell County HELP Center, presented for renewal the contract between Bell County and Central Texas Workforce Development Board in which the Bell County HELP Center provides staffing for 2-1-1 Information and Referral Call Center in Belton.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved this contract. 



  21. Agenda #9 - Interlocal Assistance Agreement

    • MINUTE ORDER #381/06:  Dan Smith, Bell County Sheriff, presented for approval the Interlocal Assistance Agreement - Regional Anti-Drug Enforcement Task Force by and between the Counties of Bell, Milam, and Coryell and the cities of Temple, Belton, Killeen, Copperas Cove, Gatesville, and Harker Heights pursuant to Section 791.001 of the Interlocal Cooperation Act, Texas Government Code.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter. 



  22. Agenda #10 - Bell County Public Health District

    • MINUTE ORDER #382/06:  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved the Agreement between Bell County and the Bell County Public Health District for the funding of $110,454 for services be the Bell County Public Health District for the Districts FY 2007, beginning September 1, 2006 and ending August 31, 2007.  



  23. Agenda #11 - iMessaging System

    • MINUTE ORDER #383/06:  Russell Williams, Assistant County Auditor, presented for approval the determination that the iMessaging System, Inc. that works with AS/400 computer system and provides automated services is a sole source provider of native AS/400 Interactive Voice Response (IVR) System and for approval for the County Auditor to proceed with the purchase of an iVoice IVR system from iMessaging Systems, Inc.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter. 



  24. Agenda #12 - Amendment No. 1

    • MINUTE ORDER #384/06:  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER FISHER, the Court unanimously approved the administrative approval and Ratification of Amendment No. 1 to Agreement Between Owner and Construction Manager dated October 19, 2004 with Skanska USA Building Inc. 



  25. Agenda #13 - Amendment No. 2

    • MINUTE ORDER #385/06:  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER FISHER, the Court unanimously approved Amendment No. 2 to Agreement between Owner and Construction Manager dated October 19, 2004 with Skanska USA Building Inc. 



  26. Agenda #14 - Claims

    • MINUTE ORDER #386/06:  Judge Jon H. Burrows, presented the claims for review to the Court.  After proper review, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor. 



      (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on any item.)


                There being no further business, the meeting adjourned.
